Proportional Fines: Fines are proportional to environmental damage and the value of the products concerned. The minimum is 4% of the company’s annual EU turnover for the previous year. In case of repeat offenses, fines can exceed the economic benefit gained from non-compliance.

Confiscation of Products or Revenues: Authorities may seize non-compliant products or the revenues generated from their sale.

Temporary Exclusion from Public Procurement: Companies may be excluded from public procurement procedures and access to public funding, such as grants or concession contracts, for a maximum period of 12 months.

Market Ban: Non-compliant products may be prohibited from being placed on the market or exported to the EU.

Private Party Remedies: Private parties, such as NGOs or citizens, can submit concerns to competent authorities and, if necessary, initiate administrative or judicial procedures to challenge decisions related to non-compliance.
